Real Estate Lending

Sherman & Howard's real estate attorneys represent both lenders and borrowers in connection with acquisition, construction, mezzanine and permanent financing and lease financings for land development, planned communities, condominiums, hotels, shopping centers, and resort communities. These transactions also commonly include large syndicated loans and loan participations, and we assist lenders in negotiating loan participations and syndications and in resolving disputes arising out of participations and syndications. We represent national and international lenders, insurance companies and retirement funds involved in construction and permanent loan transactions as well as warehouse lending and the purchase and sale of loan portfolios, and we frequently act as local counsel in large multi-state loan transactions. We represent lenders in connection with workouts, foreclosures, deeds in lieu of foreclosure, refinancings and receiverships, and we work with our construction law practice group in resolving the mechanics lien issues which frequently arise in connection with defaulted construction loans.
