Representative Matters

NLRB:

• Counsel on union avoidance strategies and wide variety of day-to-day labor relations issues
• Union organizing campaigns and NLRB elections, including decertification elections
• Unfair labor practices and prosecution of appeals in unfair labor practice litigation to federal appellate courts
• All NLRB injunction proceedings, i.e. Section 10(j), 10(l) in federal court

Collective Bargaining and Contract Administration:

• Develop strategy for negotiations, draft proposals for collective bargaining agreements, negotiate labor agreements
• Represent employer interests in grievance/arbitration for both contract interpretation and disciplinary matters under collective bargaining agreements and individual employment agreements, interest arbitration
• Labor contract administration

Strikes and Union Economic Strategies:

• Advice and counsel concerning picketing, handbilling, strikes, union economic strategies, corporate campaigns, and lockouts
• State court injunctions

Policies or Agreements:

• Draft and review policies, including severance policies, and employment and non-compete agreements

Wage and Hour Law and Protection of Trade Secrets:

• Counsel employers on wage and hour law, federal and state, including the FLSA and Davis-Bacon Act

ADR and Litigation Prevention:

• Alternative dispute resolution, litigation avoidance, employment audits

Compliance with Employment Laws:

• Counsel employers on compliance with federal, state and local employment laws and human resource issues, including reduction in force, ADA, FMLA and WARN.

• Admitted to practice before the Supreme Court of the United States; U.S. Courts of Appeal for the 5th, 7th, 9th, 11th and District of Columbia Circuits, District Court of Arizona, Eastern and Western Districts of Wisconsin
