Labor and Employment
Representative Matters
NLRB:
- Counsel on union avoidance strategies and wide variety of day-to-day labor relations issues
- Union organizing campaigns and NLRB elections, including decertification elections
- Unfair labor practices and prosecution of appeals in unfair labor practice litigation to federal appellate courts
- All NLRB injunction proceedings, i.e. Section 10(j), 10(l) in federal court
Collective Bargaining and Contract Administration:
- Develop strategy for negotiations, draft proposals for collective bargaining agreements, negotiate labor agreements
- Represent employer interests in grievance/arbitration for both contract interpretation and disciplinary matters under collective bargaining agreements and individual employment agreements, interest arbitration
- Labor contract administration
Strikes and Union Economic Strategies:
- Advice and counsel concerning picketing, handbilling, strikes, union economic strategies, corporate campaigns, and lockouts
- State court injunctions
Policies or Agreements:
- Draft and review policies, including severance policies, and employment and non-compete agreements
Wage and Hour Law and Protection of Trade Secrets:
- Counsel employers on wage and hour law, federal and state, including the FLSA and Davis-Bacon Act
ADR and Litigation Prevention:
- Alternative dispute resolution, litigation avoidance, employment audits
Compliance with Employment Laws:
- Counsel employers on compliance with federal, state and local employment laws and human resource issues, including reduction in force, ADA, FMLA and WARN.
