Representative Matters
- A mining company was sued by a former employee claiming the company had not provided the employee with all of the benefits he was entitled to under his severance agreement. The lawsuit originally involved ten claims, including breach of contract, age discrimination, securities fraud, and civil theft, and various other fraud and misrepresentation claims. Prior to trial, we were successful in eliminating all but the breach of contract claim from the lawsuit. At trial, we successfully argued in a motion in limine for a favorable damages calculation on the breach of contract claim, reducing potential damages by more than $100,000.
- Our client, a nationwide sporting goods retailer, was sued by a former loss prevention agent. The agent, an African-American, alleged the client limited his work responsibilities and manipulated his performance statistics on account of his race. He sued in federal district court in Georgia, alleging race discrimination, fraud, breach of contract, and negligent supervision. On summary judgment, the court agreed with us that the agent could not establish that the client took any action against him on account of his race, and his remaining claims were meritless. The court dismissed the case.

- Counseled multiple employers on personnel and policy decisions.
- Counseled multiple employers in development and implementation of employment policies and procedures, including job descriptions, employee handbooks, and policies regarding harassment and discrimination, discipline, electronic communications, wages and hours, and employee leave.
